  1. PROMOTER
    \nG.F. Aurora S.r.l. \"La Scialuppa\", Piazzetta marinari, 5 - 80132 Naples, P.IVA 07934211215.<\/li>\n
  2. TERRITORIAL SCOPE
    \nThe competition will take place in the territory of the Italian Republic.<\/li>\n
  3. DENOMINATION
    \nIt's on Sas\u00e0 (hereinafter, 'Competition').<\/li>\n
  4. PURPOSE
    \nThe aim of the competition is to raise awareness of 'La Scialuppa' in Piazzetta marinari, 5 - 80132 Naples.
    \n<\/del><\/li>\n
  5. RECIPIENTS
    \nThe competition is open to all persons who are going to eat lunch or dinner at a restaurant during the period of validity. Take-away and home delivery purchases are not valid<\/del>.<\/li>\n
  6. PERIOD OF VALIDITY
    \nThe competition will take place 15\/03 to 15\/04<\/del>.<\/li>\n
  7. MODE OF PARTICIPATION
    \nCustomers who have had lunch or dinner c\/o La Scialuppa, 15\/03 to 15\/04<\/del>, they will have to publish a post on their Instagram profile (stories will not be considered), tagging the account @ristorantelascialuppa<\/strong> and leave it online for the duration of the competition. Each person may only create one post per account.<\/li>\n
  8. AWARDING\/ DRAWING OF PRIZES
    \nAt the end of the competition, the Likes obtained for each published Post will be counted and the person who has obtained the highest number of Likes will be named the winner of the competition (no likes received after the last closing day will be taken into account).<\/li>\n
  9. COMMUNICATIONS AND PRIZE-GIVING
    \nWinners will be contacted via a private message on their Instagram profile within seven days of the closing date of the competition and will receive instructions on how to obtain their prize.
    \nThe winning communication will contain detailed instructions and timelines to be followed in order to obtain the prize won. Failure to comply with the instructions in the communication received will result in the prize not being awarded.
    \nThe Promoters reserve the right to carry out all the checks and investigations necessary to ascertain suspected cases of fraud or abuse in participating in the Competition and, should such cases arise, the prizes will be passed on to the next candidates.
    \nIt is the responsibility of the Recipient to ensure that the data communicated during participation, including contact details, are correct and active.
    \nIn the event of incorrect information provided by the participant, such as addresses, contact details and\/or other personal data, being untrue, incomplete or out of date, the Promoter accepts no liability for the failure to notify the winner of the win and\/or the prize due.<\/li>\n
  10. PRIZE VALUE AND DESCRIPTION OF PRIZES
    \nThe indicative total prize money amounts to \u20ac 929.00 + VAT.<\/del>
    \nThe prize up for grabs will be a dinner for 4 persons totally offered. The dinner will include xxxxxxxxxxxxxxxxx.
    \nThe prize will be valid for 3 months and can be spent from Tuesday to Friday and on Sundays, excluding public holidays.<\/del>
    \nAs far as the Promoter is concerned, it should be noted that no responsibility is attributable to him for the administration and enjoyment of the Prize.<\/li>\n
  11. WAIVER OF RECOURSE
    \nThe Promoter declares that it waives the right to reclaim withholding tax pursuant to Article 30 of Presidential Decree No. 600 of 29\/09\/1973 in favour of the winning Recipients.<\/li>\n
  12. PUBLICITY
    \nThe competition will be publicised on social media on the following Facebook and Instagram pages: https:\/\/www.facebook.com\/ristorantelascialuppa<\/a> e https:\/\/www.instagram.com\/ristorantelascialuppa\/<\/a>.
    \nThe Promoter reserves the right, if necessary, to adopt further forms of publicity, in compliance with and in accordance with the provisions of Presidential Decree 430\/2001 on prize competitions.
    \nThe advertising carried out for the purpose of communicating the event will be consistent with these regulations.<\/li>\n
  13. 13. MISCELLANEOUS
    \nParticipation in the Competition implies acceptance of all the clauses of these Rules in force during the period of validity of the Competition.
    \nPlease note that participations that do not comply with these regulations will not be considered valid.
    \nThe prizes will be delivered within the legal deadline (within 180 days after the conclusion of the prize competition).
    \nParticipation in the Competition constitutes authorisation on the part of the Participant to the processing of his or her personal data by the Promoters, as per the notice provided pursuant to article 17 of the Rules below.
    \nThe Competition shall be conducted in compliance with Presidential Decree 430\/2001 and in accordance with the instructions set out in Circular No. 1\/AMTC of 28 March of the Ministry of Productive Activities (now the Ministry of Economic Development) and in all subsequent clarifications provided by the aforesaid Ministry on prize-winning events.
    \nAny amendments that may be made to these Rules and Regulations during the course of the event shall be communicated in advance to the Participants, using the same communication methods reserved for the Rules and Regulations. Modifications and\/or additions to these Rules shall not, in any case, result in an impairment of the rights acquired by the Participants in the Competition and shall be made in compliance with the protection of public faith and the principle of equal treatment.
    \nThe Promoters accept no liability for any technical problems beyond their control that may prevent the Participants from taking part in this Contest.
    \nFor the protection of all Recipients, the Promoters reserve the right not to accept entries made in a manner that appears to be designed to circumvent the constraints of the Competition Rules; in the event that the fraudulent purpose is revealed in the stages following the awarding of the prize, the prize shall not be confirmed and the Promoter reserves the right to take any other action deemed useful to ensure the smooth running of the Competition.
    \nThe prizes at stake are not convertible into cash, nor is it open to the winner to claim, with or without the addition of cash, the possibility of receiving alternative prizes, even of lesser value.
    \nThe Promoter shall not be held liable in the event of any event preventing the smooth running of the Competition, which is not attributable to him.
    \nRecipients who, in the unquestionable judgement of the Promoter or of third parties commissioned by the same, participate using means and instruments capable of circumventing randomness or in any case judged to be suspicious, fraudulent or in violation of the normal running of the Competition, will be excluded from participation and will not be able to enjoy any prize won.
    \nTherefore, the Promoter or third parties commissioned by the same, reserve the right to proceed with any checks, with respect to all Recipients and in the terms deemed most appropriate (which, for example, include, if deemed necessary, the request for an identity document) and in compliance with applicable laws.
    \nAll the necessary checks will also be carried out to verify the fulfilment of the requirements that generated the right to participate.<\/li>\n
  14. PROCESSING OF PERSONAL DATA AND INFORMATION
    \nAurora S.r.l. \"La Scialuppa\", as Promoter, is the Data Controller, pursuant to national legislation and EU Regulation No. 679\/2016 (hereinafter \"GDPR\") on the protection of personal data.
    \nIn this regard, the Owner informs that participation in the Contest and the management of the same entail the processing of the personal data of the Recipients (hereinafter referred to as \"Data\" or \"Personal Data\") released at the time of requesting the prizes (e.g. personal data, e-mail address, telephone number), as well as further Data connected to participation in the Contest, to the extent necessary for the management of the same, to attribute the advantages connected thereto and for the time strictly necessary for this.
    \nPurposes and legal basis of the processing: The personal data of the Recipients of this event will be processed for the purposes of carrying out all the stages of the Competition: attribution of benefits, administrative, accounting, legal and prize management.
    \nThe processing will take place using computerised and manual methods, in accordance with logical criteria compatible with and functional to the purposes for which the data have been collected, in compliance with the rules of confidentiality and security laid down by law and the company's internal regulations.
    \nThis Data may be processed without your consent, as this is necessary to enable you to participate in the Competition.
    \nCompulsory or optional nature of the provision of data and consequences: The provision of Data for the purposes of participation in the Competition is optional. Failure to provide such Data will result in the impossibility for the Data Controller to carry out participation in the game as well as the delivery of the prize.
    \nScope of communication: Recipient Data will not be disseminated and may be communicated:
    \n- to persons to whom the right to access the Data is granted by law;
    \n- exclusively for the purposes described above to third parties, service providers.
    \nThese entities will process your Data in their capacity as Data Processors, if they carry out the processing on behalf of Data Controllers, or in their capacity as autonomous Data Controllers, where the processing is carried out, for example, with IT systems managed autonomously by that entity.
    \nRetention of Data: Data will be retained in full for the period of time necessary to achieve the purposes for which they are collected and processed. However, Data Holders may retain the Data also afterwards if they consider that further legal, accounting or administrative purposes continue to exist.
    \nRights of the Data Subject: In accordance with the regulations in force, in relation to the processing of Personal Data carried out, the Data Subject has the following rights pursuant to Articles 15 to 22 of the GDPR:
    \n- access: it is possible to obtain information on the processing of Personal Data and a copy of such Data;
    \n- rectification: it is possible to request that Personal Data be corrected or supplemented if the Recipient believes that the Personal Data is inaccurate, out of date or incomplete;
    \n- Deletion: it is possible to request the deletion of Personal Data, if the reasons provided for by law exist;
    \n- limitation: it is possible to request the limitation of the processing of Personal Data;
    \n- objection: you may object to the processing of your Personal Data carried out on the basis of a legitimate interest, for reasons relating to your particular situation.
    \n- Data portability: where legally possible, the Recipient has the right to receive or obtain direct transmission to another controller (if technically possible) of the personal data provided.
